Terms of Service

These Terms of Service ("Terms") are an agreement between you and XPFARM ("XPFARM", "we", "us" or "our") covering your use of xpbait.com, its pages and features (the "Site"), and the Throne Autodrain browser extension (the "Extension"). Each section starts with a short summary; the summary is there to help you read the section, and the full text of the section is what applies.

1. Accepting these Terms

In short: By using the Site, you agree to these Terms and to our Privacy Policy.

By accessing or using the Site or the Extension, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site or the Extension.

2. Eligibility: 18+ only

In short: You must be at least 18 to use the Site.

The Site is intended only for adults. By using the Site you represent that you are at least 18 years old and that you have reached the age of majority where you live. We may ask you to confirm your age, and we may suspend any account we reasonably believe belongs to someone under 18.

3. Your account

In short: You log in with Discord, and you're responsible for what happens on your account.

You log in to the Site using your Discord account. You are responsible for keeping your Discord account secure and for all activity that happens through your account on the Site. Tell us promptly at katohiroto@yahoo.com if you believe your account has been used without your permission. Your use of Discord is also governed by Discord's own terms.

4. What a contribution is

In short: A contribution is a voluntary gift. You don't receive anything in return, and we decide how the money is used.

The wishlist lets you make voluntary monetary contributions ("Contributions") toward items shown on the Site. By making a Contribution, you understand and agree that:

  1. It is a gift, not a purchase. A Contribution is a voluntary gift made of your own free will. It is not a payment for any product, service, content, access or experience.
  2. Nothing is shipped or delivered. You will not receive any item, product, service or other consideration in return for a Contribution.
  3. No rights or influence. A Contribution gives you no ownership, rights, privileges, special treatment or influence over XPFARM or its owner.
  4. Use of funds. Wishlist items and progress bars show what Contributions are intended to go toward, but once a Contribution is made, the funds may be used at XPFARM's sole discretion. We do not promise that any item will be bought, or bought within any time frame.
  5. Not a charitable donation. XPFARM is not a charity. Contributions are not tax-deductible.
  6. Wishlist information. Wishlist items, prices and images are entered by hand and are provided for information only. They may differ from listings on Throne or elsewhere, and we may change or remove them at any time.

Contributions are processed in U.S. dollars unless the Site shows otherwise. Minimum and maximum amounts are shown at checkout.

5. All contributions are non-refundable

In short: Once you contribute, you can't get the money back.

All Contributions are final and non-refundable, except where a refund is required by law. If you are charged in clear error (for example, the same Contribution was charged twice), contact us at katohiroto@yahoo.com and we will review it. Any correction of an error is at our discretion and does not change the non-refundable nature of Contributions in general.

6. Payments and saved cards

In short: Stripe handles your card. A saved card is never charged unless you confirm the exact item and amount.

  1. Payment processor. Payments are processed by Stripe, Inc. ("Stripe"). Your card details are entered with and stored by Stripe, never by us. Your payment is also subject to Stripe's terms and privacy policy.
  2. Saving a card is optional. You may choose to save a card with Stripe during checkout so you can use it for later Contributions.
  3. Explicit confirmation. A saved card is never charged automatically. Before any charge, the Site shows you the exact item, the exact amount and the card to be used, and the charge happens only after you actively confirm it.
  4. Removing cards. You can remove saved cards at any time from your dashboard.
  5. Authorization. You confirm that you are authorized to use the payment method you provide.

7. Chargebacks and payment disputes

In short: Please don't file a chargeback on a contribution you chose to make. If something's wrong, contact us first.

Because Contributions are voluntary and non-refundable, chargebacks and payment disputes on Contributions you knowingly made are not permitted under these Terms. If you have a problem with a charge, you agree to contact us first at katohiroto@yahoo.com and give us a reasonable chance (at least 30 days) to look into it.

Filing a chargeback or payment dispute for a Contribution you knowingly and voluntarily made is a breach of these Terms. If this happens, we may suspend or close your account, remove you from the Supporters list, and provide the payment processor with records showing the Contribution was authorized.

Nothing in this section limits your right to report a charge you did not authorize, such as one made after your card was stolen, to your bank or card issuer.

8. The Supporters list and display names

In short: Your contributions may appear publicly under your display name. You can hide your name, your amount, or both.

  1. Public listing. Successful Contributions may be shown on the public Supporters list under your chosen display name, together with your total and number of Contributions.
  2. Your privacy controls. From your dashboard, you can hide your name (you will appear as "Anonymous") and/or hide your amounts. Your Discord ID is never shown publicly.
  3. Display name rules. Your display name must not be offensive, hateful, sexually explicit, misleading or infringing, and must not impersonate anyone. We may change, hide or remove any display name that breaks these rules.

9. The Throne Autodrain browser extension

In short: The extension is an optional shortcut. It only acts when you click it and never makes payments.

  1. What it does. The Extension is an optional browser shortcut. When you open it, it shows the public wishlist and opens pages on the Site. It does not make payments, run in the background, read your other tabs or accounts, or act without your input. Every payment happens on the Site, with the confirmation described in Section 6.
  2. Installation. The Extension is installed manually ("sideloaded") from a .zip file. You install and use it at your own risk and can remove it at any time.
  3. License. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Extension for its intended purpose.
  4. Not affiliated. Despite its name, the Extension is not made, endorsed or supported by Throne.

10. Acceptable use

In short: Don't misuse, attack or abuse the Site.

You agree not to:

  • use the Site if you are under 18 or if the law prohibits you from using it;
  • use stolen or unauthorized payment methods, or commit fraud of any kind;
  • interfere with, disrupt, overload or try to gain unauthorized access to the Site, its systems or other users' accounts;
  • scrape, copy or harvest data from the Site using automated means;
  • impersonate anyone, or use the Site to harass, threaten or abuse anyone;
  • break any applicable law while using the Site.

11. Third-party services

In short: We use Discord, Stripe and others, and we aren't affiliated with Throne or Discord.

The Site relies on third-party services, including Discord (login) and Stripe (payments). Your use of those services is governed by their own terms, and we are not responsible for them. Links to other websites are provided for convenience only.

XPFARM is not affiliated with, endorsed by or sponsored by Throne, Discord or Stripe. All trademarks belong to their respective owners.

12. Our content

In short: The Site's design and content belong to us.

The Site, its design, text, graphics and software (including the Extension) are owned by or licensed to XPFARM and are protected by intellectual property laws. Except for the Extension license in Section 9, you may not copy, modify or redistribute them without our written permission.

13. Disclaimers

In short: The Site is provided "as is."

THE SITE AND THE EXTENSION ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY WISHLIST INFORMATION IS ACCURATE OR CURRENT.

14. Limitation of liability

In short: Our liability to you is limited.

TO THE FULLEST EXTENT PERMITTED BY LAW, XPFARM AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE EXTENSION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THE EXTENSION WILL NOT EXCEED THE GREATER OF (A) THE TOTAL CONTRIBUTIONS YOU MADE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnity

In short: If your misuse of the Site causes us a legal problem, you cover it.

You agree to defend, indemnify and hold harmless XPFARM and its owner from any claims, losses, damages and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of others.

16. Suspension and termination

In short: We can suspend accounts that break these Terms. You can stop using the Site anytime.

We may suspend or terminate your access to the Site at any time if we reasonably believe you have broken these Terms, committed fraud, or put the Site or other users at risk. You may stop using the Site at any time and may ask us to delete your account as described in the Privacy Policy. Sections 4, 5, 7 and 12–18 continue to apply after your account ends.

17. Governing law and disputes

In short: Texas law applies. Talk to us first if there's a problem.

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at katohiroto@yahoo.com and try to resolve the issue informally for at least 30 days. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in the State of Texas, and you and we consent to the personal jurisdiction of those courts.

18. Changes to these Terms

In short: We may update these Terms, and the date at the top will change.

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page, and for significant changes we may also give notice on the Site. If you keep using the Site after changes take effect, you accept the updated Terms.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a sale or reorganization of the Site. These Terms and the Privacy Policy are the entire agreement between you and us about the Site.
